Notice of Passing: Concerning Zoning Amendment By-law 3358-134: Pursuant to Section 34 of the Planning Act, R.S.O. 1990. C.P.13

TAKE NOTICE that, in accordance with the provisions of the Planning Act, R.S.O. 1990, c.P.13 as amended, the council of the Town of Perth passed By-law No. 3358-134 on the 27th day of August, 2024 to amend Comprehensive Zoning By-law No. 3358, as it pertains to land described as PT LT 8 S/S ROBINSON ST PL 8828 LANARK S DRUMMOND, DESIGNATED AS PART 1 ON PLAN 27R12157; TOWN OF PERTH.

AND TAKE NOTICE that any specified person, as defined in the Planning Act, or public body that commented before the passing of the By-law may appeal to the OLT in respect of By-law No. 3358-134 by filing with the Clerk of The Corporation of the Town of Perth a Notice of Appeal to the OLT setting out the objection to the By-law and the reasons in support of the objection together with the fee required by the OLT not later than the 16th Day of September 2024. 

AND TAKE NOTICE that no person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

THE PURPOSE of By-law No. 3358-134 is to change the zoning of the property from a site-specific Residential Fourth density (R4-20) to a new site-specific Residential Third Density (R3-16) Zone. The effect of the amendment is to enable the development of the land to accommodate three dwellings (tiny homes) intended for affordable housing. Three ground mounted solar installations as well as a garden are proposed as part of the development. Site-specific relief is required to recognize multiple dwellings on the property, to permit a reduced parking ration of 1.25 spaces per unit, and to permit the solar structures as proposed.

THE EFFECT of the proposed rezoning would change the existing uses of the site.

THE EFFECT of Public Input on this Decision: A summary of written and oral submissions received relating to the by-law and staff responses to the submissions were in the Staff Recommendation Report. Any additional written submissions received after the, completion of the Recommendation Report were considered by Council and through consideration of the report and submissions, Council supported the by-law, with amendments.
